1Introduction
Welcome to Saino ("we," "us," "our"). These Terms of Service ("Terms") govern your access to and use of our mobile application ("App") and services ("Services"). By creating an account or using the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use our Services.
2Definitions
- "User": any individual who creates an account or uses our Services.
- "Verified User": a User who has completed our verification process.
- "Premium Services": paid features or subscriptions available within the App.
3Eligibility
You must be at least 18 years old to use our Services. By creating an account, you represent and warrant that:
- You are not prohibited by law from using dating or matrimony services.
- You will use the Services in compliance with all applicable laws.
- You have not been convicted of a violent, sexual, or fraud-related crime.
4Account Registration & Security
- You may only create one account per person.
- You must provide accurate, complete, and updated information.
- You are solely responsible for maintaining the confidentiality of your login credentials.
- You may not share, sell, or transfer your account.
- If your account is compromised, you must notify us immediately.
5Verification & Safety
- We may require government-issued ID and/or a real-time selfie for verification.
- We reserve the right to re-verify your account at any time.
- Use of fake identities, stolen photos, or impersonation will result in immediate termination and may be reported to authorities.
- Background checks: Saino does not conduct criminal background checks but may use automated tools to detect suspicious activity. Users are responsible for exercising caution, especially when meeting offline.
6User Conduct
You agree that you will not:
- Use the App for any illegal, fraudulent, or unauthorized purpose.
- Harass, stalk, threaten, or harm other users.
- Impersonate another person or entity.
- Request money, financial support, or gifts from other users.
- Share content that is:
- Offensive, obscene, defamatory, or discriminatory.
- Sexual or pornographic in nature.
- Violent, abusive, or promoting hate speech.
- Solicit or advertise third-party products or services.
- Collect or misuse personal data from other users without consent.
8Premium Services & Payments
- Certain features require paid subscriptions ("Premium Services"), such as sending more than 2 moves (match requests) a day, sending more than 5 chat messages to a match, and using the search by last name feature.
- Fees are displayed at the time of purchase and are non-refundable, except where required by law.
- Subscriptions may automatically renew unless canceled before the billing cycle ends.
- By purchasing, you authorize us and our payment processors (e.g., Esewa, credit/debit card providers) to charge your selected payment method.
- Pricing and features may change at any time, with notice provided where required by law.
9Reporting & Blocking
- Users may report or block others who engage in misconduct.
- Reports are reviewed, but we reserve full discretion on whether and how to act.
- Repeated violations may lead to account termination.
10Termination
We may suspend or terminate your account, without refund, if:
- You violate these Terms or our Privacy Policy.
- You engage in suspicious, harmful, or fraudulent activity.
Upon termination, you lose access to your account and any associated Content.
11Disclaimers
- The Services are provided "as is" without warranties of any kind.
- We do not guarantee that you will find a match, relationship, or marriage through the App.
- We do not verify the identity or background of every user. You assume all risks associated with online and offline interactions.
12Limitation of Liability
To the fullest extent permitted by law:
- Saino shall not be liable for any indirect, incidental, or consequential damages, including loss of data, reputation, profits, or safety.
- We are not responsible for the conduct of users, whether online or offline.
- Your exclusive remedy for dissatisfaction with the Services is to discontinue using them.
13Indemnity
You agree to indemnify, defend, and hold harmless Saino, its affiliates, officers, and employees from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your use of the Services,
- Your violation of these Terms, or
- Your interactions with other users.
14Intellectual Property
- All rights to the App, trademarks, logos, design, and features belong to Saino.
- You may not copy, modify, reverse-engineer, or distribute any part of our Services without written permission.
15Governing Law & Dispute Resolution
- These Terms are governed by the laws of Nepal.
- Any disputes will be resolved first through mediation/arbitration before proceeding to court.
- If court proceedings are necessary, they must be filed in Kathmandu, Nepal.
16Changes to Terms
We may update these Terms at any time. The "Last Updated" date will reflect changes. Continued use of the App constitutes your acceptance of the revised Terms.
